    Terms of Service

    1. Acceptance of Terms

    By creating an account, clicking "Start my journey" (or equivalent action), accessing or using ParentLevel (the "Service" or "App"), you declare that you have read, understood, and expressly agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms in their entirety, you are not authorized to access or use the Service.

    You represent and warrant that you have the legal capacity to enter into this agreement, or that you are using the Service under the supervision and responsibility of a legal guardian. If you are acting on behalf of a legal entity, you represent that you have authority to bind it to these Terms.

    These Terms constitute a legally binding agreement between you and ParentLevel, effective from the first access or use of the Service, whichever occurs first.

    For material changes to these Terms, ParentLevel may notify you by reasonable means, including but not limited to email or notices within the Service. Where required by applicable law, your explicit consent will be requested before such changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

    By using the Service, you acknowledge and agree that your personal data may be collected, used, and processed as described in the Privacy Policy, in accordance with applicable data protection laws, including, where applicable, the General Data Protection Regulation (GDPR) and equivalent legislation.

    2. Eligibility

    You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater) to create an account and use ParentLevel (the "Service"). By accessing or using the Service, you represent and warrant that you:

    • Meet the applicable minimum age requirement;
    • Have full legal capacity to enter into a legally binding contract;
    • Are not prohibited from using the Service under any applicable law;
    • All information provided is true, accurate, current, and complete; and
    • Are a parent, legal guardian, or have valid authorization to manage information and activities related to minors in your care.

    The Service is intended exclusively for adults responsible for minors, including parents, legal guardians, or caregivers. Direct use of the Service by persons under 18 is strictly prohibited.

    ParentLevel may allow the creation of linked profiles or environments ("zones") intended for limited viewing by minors. Such access does not constitute independent accounts, does not create any direct contractual relationship between the minor and ParentLevel, and is entirely controlled by the account holder.

    You are solely responsible for all use of the Service through your account, including any access by minors through "zones", as well as all content, data, and interactions in that context.

    When entering or managing information related to minors, you represent and warrant that you have all necessary rights, authorizations, and legal bases to do so, and are solely responsible for such information.

    ParentLevel reserves the right, at its sole discretion, to suspend or terminate accounts and remove content if it identifies or suspects a violation of this section, including but not limited to misuse by minors, account creation by ineligible persons, or provision of false information.

    ParentLevel does not intentionally collect personal data directly from minors. Any information related to minors is provided exclusively by the legal guardian, under their responsibility and in compliance with applicable law.

    If ParentLevel becomes aware that personal data of minors has been collected in violation of these Terms or applicable law, it may take steps to remove such data and terminate the associated account.

    3. Description of Service

    ParentLevel is a digital platform for personal and family development, based on gamification, intended for adults responsible for minors. The Service offers tools for routine organization, habit building, and progress tracking, including but not limited to:

    • Individual and couple challenges and journeys focused on personal, relationship, and family development;
    • Setup and tracking of routines, activities, rewards, and incentive systems (such as points, levels, and achievements);
    • Linked environments ("zones") with limited viewing access for minors, under the exclusive control of the account holder;
    • Progress tracking tools, logs, and check-ins for self-reflection;
    • Optional features related to personal organization, including functionalities such as cycle or routine tracking;
    • Optional social features such as shared challenges and user interactions.

    Important: ParentLevel is an organizational and motivational support tool. The Service does not provide medical, psychological, therapeutic, clinical, educational, or professional advice of any kind. No feature, including journeys, challenges, or resources related to wellness or personal cycles, should be interpreted as a substitute for qualified professional guidance.

    ParentLevel does not guarantee specific results, behavioral improvement, relationship quality, parenting performance, or any other outcomes from using the Service.

    Use of the Service, as well as any decisions made based on its content or features, is entirely the user's responsibility. You are solely responsible for configuring, interpreting, and applying the activities, routines, and information entered in the Service, including those related to minors.

    ParentLevel may modify, update, limit, or discontinue Service features at any time, with or without notice, without creating any right to compensation.

    ParentLevel does not actively monitor, independently verify, or validate information entered by users, including any data related to minors or personal matters. Processing of such information occurs in an automated manner as described in the Privacy Policy.

    4. User Accounts and Security

    To use the Service, you must create an account. The account is personal, non-transferable, and your sole responsibility. You are solely responsible for maintaining the confidentiality of your access credentials and for all activities carried out through your account, including any access by third parties or minors through linked environments ("zones").

    By using the Service, you agree to:

    • Provide true, accurate, current, and complete information during registration and keep it up to date;
    • Protect your access credentials and not share them with unauthorized third parties;
    • Immediately notify ParentLevel at parentlevel@gmail.com of any suspected unauthorized use, security breach, or improper access to your account;
    • Assume full responsibility for all actions taken in your account, regardless of whether they were authorized by you, except as required by law.

    ParentLevel shall not be liable for any losses, damages, or harm resulting from unauthorized use of your account, except where directly and exclusively caused by a failure of the Service.

    You are responsible for ensuring that access to the Service, including through "zones" or other linked mechanisms, occurs appropriately, securely, and under your supervision, especially when involving minors.

    ParentLevel may, at its sole discretion, suspend, restrict, or terminate your account, as well as remove or limit access to the Service, if it identifies or suspects:

    • Violation of these Terms;
    • Misuse or fraudulent use of the Service;
    • Risk to the security, integrity, or functioning of the Service; or
    • Use that may create legal liability for ParentLevel or third parties.

    Whenever reasonably possible, ParentLevel will provide prior notice of suspension or termination measures. However, in cases of urgency, security risk, suspected fraud, or legal requirement, such measures may be taken immediately without prior notice.

    You are responsible for ensuring that use of the Service complies with applicable data protection laws, especially regarding the entry and management of personal data of third parties, including minors.

    5. Acceptable Use

    You agree to use the Service exclusively for lawful, personal purposes and in accordance with these Terms. You are fully responsible for all use of the Service through your account, including any access by third parties or minors through linked environments ("zones"). You agree not to:

    • Use the Service for any illegal purpose or in violation of applicable laws and regulations;
    • Attempt to gain unauthorized access to any part of the Service, systems, servers, or other users' accounts;
    • Interfere with, disrupt, degrade, or harm the functioning of the Service or its infrastructure;
    • Circumvent, disable, or interfere with security or control mechanisms of the Service;
    • Use bots, scripts, scrapers, or any automated means to access, collect data, or interact with the Service in an unauthorized manner;
    • Reverse engineer, decompile, disassemble, or attempt to extract the source code or logic of the Service;
    • Provide false, misleading, outdated, or fraudulent information;
    • Impersonate another person or entity, or misrepresent your identity or affiliation;
    • Manipulate, exploit, or abuse the gamification system or any features to gain undue advantages;
    • Use the Service to send unsolicited communications, spam, or any form of unauthorized advertising;
    • Insert, share, or use content that violates third-party rights, including privacy, image rights, or personal data of minors without proper authorization;
    • Use the Service in a way that could cause physical, emotional, or psychological harm to any person, including minors;
    • Use the Service in a manner incompatible with its purpose, including any use that could create legal liability for ParentLevel;
    • Collect, enter, or share personal data of third parties, especially minors, in violation of applicable data protection law or without the necessary legal basis or authorization;

    ParentLevel may, at its sole discretion, investigate, suspend, restrict, or terminate access to the Service, as well as remove content, at any time and without notice, in the event of actual or suspected violation of this section.

    Violation of this section may result in immediate termination of your account without right to refund, without prejudice to other available legal remedies.

    6. Subscription, Billing, and Refunds

    ParentLevel offers both a free tier and paid subscription plans. When subscribing to a paid plan, you agree to the terms below:

    • Fees: Subscription fees are clearly displayed at the time of purchase and charged in advance on a recurring basis (monthly or annually, depending on the selected plan).
    • Automatic renewal: Your subscription will automatically renew at the end of each billing cycle for the same period, unless cancelled in advance. For annual plans, ParentLevel may send a renewal reminder with reasonable advance notice where required by applicable law.
    • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, with access to paid features retained until that date. No further charges will occur after effective cancellation.
    • Refunds: Brazilian users may exercise the right of withdrawal within 7 (seven) calendar days from the date of purchase, pursuant to Article 49 of the Brazilian Consumer Protection Code. Users located in the European Union may exercise the right of withdrawal within 14 (fourteen) days, in accordance with applicable law. After these periods, amounts paid are non-refundable, except as required by law. By immediately using Service features after purchase, you acknowledge that you may lose the right of withdrawal where permitted by applicable law.
    • Price changes: ParentLevel may change subscription prices with at least 30 (thirty) days' prior notice. Changes will not affect already-paid billing periods. Continued use of the Service after new prices take effect constitutes acceptance to the extent permitted by applicable law.
    • Taxes: Displayed amounts may not include applicable taxes, government fees, or charges, which may be added as required by law.
    • Failed payments: In the event of a failed payment, ParentLevel may retry the charge, suspend or limit access to paid features, or downgrade the account to the free tier until the issue is resolved.

    Family plans: Certain ParentLevel plans may allow sharing access with a limited number of linked users, such as a spouse or family members. The subscription holder is solely responsible for managing the plan, including adding and removing linked users.

    All linked users use the Service under the responsibility of the account holder. The holder agrees to be responsible for all activities conducted under the plan, including any actions by linked users.

    Plan sharing must comply with the criteria established by ParentLevel, which may be limited to persons sharing the same household or family relationship, where applicable.

    ParentLevel reserves the right to limit, suspend, or terminate plans that are used in violation of these conditions.

    Misuse and disputes: ParentLevel reserves the right to suspend or terminate accounts involved in fraudulent use, refund policy abuse, or improper payment disputes (chargebacks), without prejudice to other available legal remedies.

    7. Intellectual Property

    All content, features, functionalities, and technology of ParentLevel — including but not limited to texts, journeys, challenges, gamification mechanics, flows, design, graphics, icons, code, databases, brand, logo, and visual identity — are the exclusive property of ParentLevel or its licensors and are protected by applicable intellectual property laws.

    Subject to these Terms, ParentLevel grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service exclusively for personal and non-commercial purposes.

    You may not, directly or indirectly: copy, reproduce, modify, adapt, translate, distribute, transmit, display, sell, license, commercially exploit, or create derivative works from any part of the Service, including its features, structure, logic, or mechanics, without the prior written authorization of ParentLevel.

    You agree not to use ParentLevel's trademarks, names, logos, or any distinctive signs without prior written authorization.

    Any suggestion, feedback, idea, or contribution you provide related to the Service may be freely used by ParentLevel without any obligation of compensation, attribution, or restriction.

    Unauthorized use of the Service or its elements may result in suspension or termination of your account, without prejudice to other available legal remedies.

    8. User Content

    The Service may allow you to enter, submit, or manage content, including but not limited to profile information, data related to minors (such as names, ages, and routines), logs, check-in responses, and other information ("User Content").

    You retain ownership of your User Content. By providing such content, you grant ParentLevel a worldwide, non-exclusive, royalty-free license for the period necessary to operate the Service, to use, store, process, reproduce, and display that content exclusively for purposes of operating, maintaining, improving, and developing the Service, as described in the Privacy Policy.

    You represent and warrant that: (i) you have all the rights, authorizations, and legal bases necessary to provide User Content, including regarding third-party and minor data; (ii) User Content does not violate applicable laws or third-party rights, including privacy and image rights; and (iii) the content you provide is your sole responsibility.

    ParentLevel does not validate, monitor, or guarantee the accuracy, truthfulness, or legality of User Content, nor assumes any responsibility for it. Use of and reliance on any content entered in the Service is entirely your responsibility.

    ParentLevel reserves the right, but not the obligation, to review, remove, restrict, or block User Content at any time and without notice, if it determines that such content may violate these Terms, applicable law, or pose risks to ParentLevel or third parties.

    You may request deletion of your User Content under applicable law, as detailed in the Privacy Policy.

    ParentLevel does not use User Content for purposes other than those necessary for providing the Service, except where permitted by law or with additional consent when required.

    9. Disclaimer of Warranties

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ParentLevel AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, CONTINUOUS AVAILABILITY, ERROR-FREE OPERATION, SECURITY, OR ACCURACY.

    Without limiting the above, ParentLevel does not warrant that: (i) the Service will meet your specific needs or expectations; (ii) the Service will be continuous, uninterrupted, timely, secure, or error-free; (iii) results obtained from use of the Service will be effective, accurate, or reliable; or (iv) any defects or errors will be corrected.

    ParentLevel does not provide medical, psychological, therapeutic, educational, or professional advice of any kind. The Service is only an organizational and motivational support tool. Any decision made based on the Service, including those related to family routines, personal development, relationship quality, or care of minors, is entirely your responsibility.

    ParentLevel does not guarantee any results related to use of the Service, including but not limited to behavioral improvements, child development, relationship quality, or achievement of goals.

    You acknowledge that use of the Service may involve processing of data you enter and that ParentLevel does not guarantee the accuracy, integrity, or currency of such information.

    No information or guidance provided by ParentLevel, whether through the Service, communications, or support, creates any warranty not expressly set forth in these Terms.

    Nothing in this section limits or excludes warranties that cannot be excluded under applicable law. Brazilian consumers retain their rights under the Consumer Protection Code, and users in the European Union retain their mandatory legal rights.

    10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

    • ParentLevel, its directors, employees, agents, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of profits, revenue, data, opportunities, business interruption, reputational harm, or any damages arising from decisions made based on use of the Service.
    • ParentLevel shall not be liable for any damages arising from: (i) use or inability to use the Service; (ii) errors, omissions, or inaccuracies in content; (iii) unauthorized access, security failures, or data loss; (iv) unavailability, interruptions, or technical failures; (v) use of the Service by third parties or minors through linked environments ("zones"); or (vi) any user-provided content.
    • Our total and aggregate liability to you for all claims arising from or related to these Terms or use of the Service shall be limited to the greater of: (a) the amount actually paid by you to ParentLevel in the 12 (twelve) months preceding the event giving rise to the claim; or (b) 100 (one hundred) US dollars when no payment has been made.
    • The above limitations apply regardless of the form of action, whether contractual, tortious (including negligence), strict liability, or any other legal theory.

    Nothing in this section limits or excludes liability that cannot be limited or excluded under applicable law, including, where applicable, liability for death, bodily injury, fraud, willful misconduct, or violation of fundamental consumer rights.

    In jurisdictions that do not allow the exclusion or limitation of certain damages, ParentLevel's liability shall be limited to the maximum extent permitted by applicable law.

    11. Indemnification

    You agree to defend, indemnify, and hold harmless ParentLevel, its directors, employees, affiliates, partners, agents, and licensors from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

    • Your access, use, or misuse of the Service;
    • Your violation of these Terms or any applicable policies;
    • Your User Content, including any personal data entered, especially data related to third parties or minors;
    • Your violation of any applicable law, including data protection, privacy, or third-party rights;
    • Use of the Service by third parties linked to your account, including spouse, family members, or minors through linked environments ("zones"); or
    • Any disputes, claims, or damages arising from decisions you made based on use of the Service.

    12. Force Majeure

    ParentLevel shall not be liable for any failure or delay in performing its obligations resulting from causes beyond its reasonable control, including but not limited to acts of nature, natural disasters, war, terrorism, labor disputes, internet outages, infrastructure failures, cyberattacks, or government actions.

    13. Termination

    ParentLevel may, at its sole discretion, suspend, restrict, or terminate your access to the Service, in whole or in part, if it identifies or suspects: (i) violation of these Terms; (ii) misuse, fraud, or use that may create legal liability; (iii) risk to the security, integrity, or functioning of the Service; or (iv) non-compliance with applicable laws, including data protection regulations. Where reasonably possible, prior notice will be provided, except in cases of urgency, fraud, or imminent risk.

    ParentLevel may also terminate or discontinue the Service (or part of it) for commercial, technical, or legal reasons. In such cases, where applicable, reasonable prior notice and a proportional refund of unused prepaid amounts will be provided.

    You may terminate your account at any time through the Service settings or by contacting parentlevel@gmail.com. Cancellation does not affect pending obligations, including amounts due up to the effective date of termination.

    After termination: (i) your license to use the Service will cease immediately; (ii) access to content and features may be terminated; and (iii) your data may be deleted or anonymized in accordance with the Privacy Policy and applicable law.

    Provisions that by their nature should survive termination — including but not limited to Sections 7 (Intellectual Property), 8 (User Content), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law and Dispute Resolution) — will remain in effect.

    14. Governing Law and Dispute Resolution

    These Terms and any disputes arising from or related to them shall be governed by the laws of Brazil, without regard to its conflict of law rules. If you are a consumer in the European Union, the mandatory consumer protection rules of your country of residence also apply and are not displaced by this clause.

    Informal resolution: Before initiating any formal proceeding, you agree to contact parentlevel@gmail.com to attempt to resolve the dispute in good faith within a reasonable time.

    Arbitration: Where permitted by applicable law, any disputes shall be resolved by binding arbitration under the rules of the Brazilian Business Mediation and Arbitration Chamber (CAMARB), seated in São Paulo, Brazil, conducted in Portuguese. The arbitral award shall be final and binding.

    Consumer rights: Nothing in this section limits the right of consumers to appeal to consumer protection agencies, competent authorities, or the courts, where such rights cannot be restricted by law.

    Class actions: To the maximum extent permitted by applicable law, you agree to resolve disputes on an individual basis. This provision does not apply where waiver of class actions is prohibited by law, including in Brazil and the European Union.

    Either party may seek injunctive or emergency relief from a court of competent jurisdiction to prevent immediate or irreparable harm, without prejudice to arbitration where applicable.

    15. General Provisions

    • Entire agreement: These Terms, together with the Privacy Policy and any additional policies incorporated by reference, constitute the entire agreement between you and ParentLevel regarding the Service and supersede all prior agreements, communications, or understandings.
    • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent authority, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
    • No waiver: Any tolerance or failure by ParentLevel to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
    • Assignment: You may not assign, transfer, or sublicense these Terms, in whole or in part, without the prior written consent of ParentLevel. ParentLevel may freely assign or transfer these Terms, including in the event of merger, acquisition, corporate reorganization, or sale of assets.
    • Notices: ParentLevel may send notices through the Service, by email, or by other reasonable means. You are responsible for keeping your contact information up to date. Notices shall be deemed received on the date of sending or publication, as applicable.

    16. Changes to These Terms

    ParentLevel may modify these Terms at any time at its discretion. For material changes, reasonable prior notice will be provided through the Service, email, or other appropriate means.

    Where required by applicable law, your explicit consent will be requested before changes take effect. In other cases, continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

    If you do not agree with the changes, you must stop using the Service and may terminate your account before the effective date.

    Changes related to pricing remain subject to the minimum 30 (thirty) day notice period set out in Section 6, which prevails over any contrary provision.
